I am divorced and the ex got the house. She is still working on refinancing the loans to get my name off. She is having trouble because now bank is saying “loan value higher the house value”. Well, the mortage interest statement came in and had my SSN. Since we are divorced and filing seperately, will she be able to claim the interest.
I am not arguing which get it…I am just curious if she will be able to because of my SSN being on statement.

    Either one of you can claim the interest, but it has to be the one (since you are now divorced) that actually PAID the payment.

    Tricky. Did you pay half or she paid it in full?

    Even though your name is on it, the person that paid should file for the deduction. Good luck.

    The person that will be able to claim the interest is the person that can show that they made the mortgage payments. If it is not you, IRS will accept her claim and come after you if you claimed it.

    If it was you, IRS will credit you and go after the ex. Claiming things that one should not claim is the only thing that IRS worries about.
