The person that will be able to claim the interest is the person that can show that they made the mortgage payments.  If it is not you, IRS will accept her claim and come after you if you claimed it.

If it was you, IRS will credit you and go after the ex.   Claiming things that one should not claim is the only thing that IRS worries about.</description>
